SHORT CUTS: |
TITLE
1.1 The name shall be the
OBJECTS
2.1 To secure, maintain and promote fisheries on and around the
TRUSTEES
3.1 There shall be not less than three Trustees of the Association.
3.2 Trustees shall hold office until death or by resignation, or until
removed by the Executive Committee.
3.3 All properties, leases, licences for angling shall be vested in the Trustees
to be dealt with by them as the Executive Committee shall direct. (Excluding
cash, which shall be under the control of the Treasurer.)
3.4 The Trustees shall be indemnified out of the assets of the
Association against any risk and expense by them in the pursuance of their
office.
MEMBERSHIP
4.1 The Membership shall be open to all bona-fide Angling Clubs,
Societies, Associations and Amalgamations, as well as to individual anglers.
4.2 Membership in any class may be limited by the paid up members at the
next General Meeting.
SUBSCRIPTIONS
5.1 All fees shall be such sum as the members decide at a General
Meeting. They shall be payable annually by June 1st. Permits will not be issued
until Subscription Fees have been paid in full.
RESIGNATIONS
6.1 A member or individual may resign their membership at any time by
notice in writing to the Secretary, but a member whose written resignation is
received by the Secretary after their subscription for the current year has
become due, shall be liable for their subscription for that year.
EXPULSIONS
7.1 The Executive Committee shall expel from the Association any member
for conduct, which in their opinion is injurious, or tends to be injurious, to the
interests of the Association, or its objects, or its members or angling. Before
expelling a member the Executive Committee shall inquire into their conduct and
they shall be given a reasonable opportunity to defend themselves either in
writing or by appearing before the Executive Committee as they shall elect. The
Executive Committee's power to expel shall be on a majority vote of those
present at the inquiry.
7.2 An expelled member shall forfeit all rights and privileges of
membership but shall be liable for any dues or debts to the Association which
became payable or were incurred before the date of expulsion.
MANAGEMENT
8.1 The management of the Association shall be vested in the
Executive Committee. (Except where otherwise provided for in the Rules.)
OFFICERS
9.1 A President, Vice President (ex-officio members), Chairman, Vice
Chairman, Secretary, Secretary, Treasurer, Match Secretary, Fisheries Officer,
Head Bailiff and Rota Officer shall be elected at the AGM to serve for a
period of three years, after being proposed and indicating their consent and
shall be members of the Executive Committee.
THE EXECUTIVE COMMITTEE
10.1 The Executive Committee shall consist of all the Officers and not
less than six members of the Association elected at an AGM and shall have the
power to co-opt up to two members and may at their discretion invite any
person, whether members of the Association or not, to attend any Executive
meeting.
10.2 At the AGM each year one-third of the Committee (or the number
nearest one-third) being those longest on the Committee since last elected
shall retire from office, but shall be eligible for re-election with any
nomination for the vacancies to be filled.
10.3 The Executive Committee shall have the power to fill any casual
vacancy on the Executive Committee and any member so appointed shall retire at
the next AGM but shall be elegible for re-election.
10.4 The Executive Committee shall meet at least four times a year to
examine the accounts and to arrange the affairs of the Association. Minutes
shall be taken at each meeting.
10.5 Four members shall comprise a quorum for the transaction of business
at any Executive Committee meeting.
10.6 The positions of Secretary, Treasurer, Fisheries Officer and
MEETINGS
11.1 There shall be an AGM during the month of October and Delegates
Meetings during February and May.
11.2 Each full member shall be entitled to send two delegates to
represent them and each full member shall have one card vote.
11.3 Four weeks notice of such meetings will be given, by the Secretary,
to each club. Matters for the agenda must be received, by the Secretary, not
later than six weeks prior to the date of the meeting. Matters not appearing on
the agenda may be taken at the direction of the Chairman.
11.4 Ten members eligible to vote shall comprise a quorum for the
transaction of business at any General Meeting.
11.5 AGM/EGM PROPOSALS; items intended by the way of proposals at meetings
must be notified to member clubs at least four weeks prior to the meeting.
FINANCE
12.1 The financial year shall end on the 31st March each year and the
Association's accounts shall be made up to and including that day. The
accountsshall be audited by a chartered accountant. The funds shall be kept in
a bank account.
DISSOLUTION
13.1 If at any time the Association shall pass in general meeting by a
majority comprising two-thirds or more of the members present and entitled to
vote, a resolution of its intention to dissolve, proper notice of which has
been duly given, the Executive Committee or failing them, the Trustees, shall
take immediate steps to discharge all debts and liabilities of the Association
and thereafter, to vest, give or transfer the remaining assets of the
Association to some other voluntary organisation or organisationshaving objects
similar to those of the Association. Upon the disposal of the remaining assets
of the Association in accordance with the provisions thereof the Association
shall for all purposes be dissolved.
INTERPRETATION
14.1 The Executive shall be the sole Authority for the interpretation of
the Association's Rules and Bye-laws, and the decision of the Executive upon
any question of interpretation, or any matter affecting the Association not
provided for in the Rules or Bye-laws shall be binding on the members.
14.2 In the Association Rules and Bye-laws where the context permits,
words importing the masculine shall include the feminine, and words importing
the singular shall include the plural and vice versa.
CATEGORIES OF MEMBERSHIP
1.1 Membership of the Association shall consist of the following groups:
(a) Full Members.
(b) Individual Members.
(c) Temporary Individuals.
(d) Honorary Life Members
(a) FULL MEMBERS: Any bona fide angling
club, association or society, whose application for affiliation has been
accepted by the Executive Committee.
(b) INDIVIDUAL MEMBERS: Any individual
who is not a member of a club, provided they have paid the appropriate joining
fee. An Individual Member shall be allowed all the privileges of an ordinary
member. However, they shall not be entitled to vote at any delegates meeting.
(c) TEMPORARY INDIVIDUALS: Any individual
who has paid the appropriate joining fee to an authorised outlet or bailiff to
cover membership for a limited period.
(d) HONORARY LIFE MEMBERS: Any individual
who is proposed and accepted at an AGM in recognition of outstanding services
to the Association.
1.2 Senior citizens, disabled persons and juniors can obtain membership
at a reduced rate. A junior is a person over the age of 12 and under the age of
16 at the time a joining fee is paid.
EXECUTIVE COMMITTEE
2.1 All members of the Executive Committee must either be members of a
full members club, or an Individual Member. If at the time of election they are
delegates for that club then they must cease to represent that club immediately
and the club shall then appoint a new delegate.
2.2 The Committee have the power to make and enforce rules which shall be
ratified or rescinded at the next AGM.
OFFICER'S DUTIES
3.1 CHAIRMAN: To conduct all
meetings with control, see that the business on the agenda is carried out and
provide fair time for discussion on all points. The Chairman can terminate all
discussions when in his opinion a reasonable time has elapsed.
3.2 VICE CHAIRMAN: To take over the responsibilities of the
Chairman in his absence.
3.3 SECRETARY: (i) To deal with
correspondence and all general business.
(ii) To call all Executive Committee, Delegates and General Meetings and
to provide agendas for the same.
(iii) To report at all Executive Committee, Delegates and General
Meetings.
(iv) To keep minutes of all Executive Committee, Delegates and General
Meetings and to distribute the same to whom concerned.
3.4 TREASURER: (i) To handle all
financial transactions on behalf of the Association.
(ii) To keep an accurate and detailed account of such transactions.
(iii) To issue all season and temporary permits.
(iv) To report at all Executive Committee, Delegates and General Meetings
on the current state of the accounts.
3.5 FISHERIES OFFICER: (i) To
make all arrangements necessary for the upkeep and improvementof the
Association fisheries.
(ii) To form and chair a select body of members as a Fisheries Committee.
(iii) To report at all Executive Committee, Delegates and General
Meetings.
3.6 MATCH SECRETARY: (i) To make
all arrangements necessary for the matches as agreed by the Executive
Committee.
(ii) To form and chair a select body of members as a Match Committee.
(iii) To report at all Executive Committee, Delegates and General
Meetings.
3.7
(ii) To keep a record of such allocations and to notify the Canal
Management of the same.
(iii) To collect a deposit and peg fees from non-member clubs or persons
booking the canal for matches.
3.8 HEAD BAILIFF: (i) To form
and administer a select body of members as Bailiffs.
(ii) To maintain records of permits and warrant cards issued to Bailiffs.
(iii) To record all proceeds from the sale of permits by Bailiffs.
(iv) To inform the Treasurer of all permit transactions, and forward all
monies recieved from the Bailiffs to the Treasurer.
(v) To report at all Executive Committee, Delegates and General Meetings.
3.9 COMMITTEE MEMBERS: To assist
the Officers whenever required.
FINANCE
4.1 On acceptance into the Association a club shall pay an initial
joining fee.
4.2 Each full member club will pay an annual subscription fee based on
the numerical value of their total membership. There is to be a minimum
subscription fee.
4.3 All cheques are to be signed by two of the following Officers: the
Chairman, the Treasurer. The Secretary and one other Officer.
DELEGATES & GENERAL
MEETING
5.1 Whenever possible these meetings shall be held on the third Tuesday
of the month.
5.2 Each full member club must be represented at a least one meeting a
year otherwise a non-attendance fee will be charged in addition to the
subscription fees.
5.3 A general meeting may be called at the request of ten full members.
CHILD PROTECTION
6.1 The Basingstoke Canal Angling Association is intent that children,
young people and vulnerable adults will find angling a safe environment in which
to have fun, learn and develop, and will seek to ensure this by adopting, using
and promoting the JAGB Child Protection Policy Guidelines Document.
1 All bylaws, made by the Environment Agency (Thames Region) and the
Hampshire and Surrey County Councils, that affect the canal and its surrounding
areas must be complied with at all times.
2 No person may use any fishing apparatus in the canal without permission
from the Association and then only in accordance with these rules.
3 Any person over the age of 12 and fishing the canal, but not in
possession of a current membership permit to which a recent passport type
photograph has been affixed and signed, is liable to pay for temporary
membership. Photograph to be affixed within two days of purchase of permit.
4 No person may fish the canal without being in possession of a current
EA rod licence of the correct category.
5 Fishing shall be by rod and line only and from the towing path only.
6 No person shall fish from any privately owned or hired floating craft
nor any extemporary raft or vessel, nor any dock or landing stage nor within 20
metres of any lock, bridge or aqueduct.
7 Persons may fish the canal only in the prescribed open season.
8 No person shall place in the
canal any live freshwater fish nor any animal which is not at present
indigenous to the canal or which has been obtained from any source other than
the canal.
8a No person shall place in the canal
any dead fish or animal which is not at present indigenous to the canal except
for those baits which are properly regarded and recognised as predatory fish
baits and which are to be used solely for the purpose of angling.
9 Members shall not obstruct the towing path whilst fishing nor shall
they enter any installation or property which is out of bounds.
10 Persons fishing may not be in possession of, nor operate any noise
making apparatus, except for properly designed bite alarms.
11 Persons fishing may not light or maintain fires.
12 Persons fishing may not have in their possession any domestic or wild
animal except those used in fishing techniques.
13 Persons fishing may not use more than two rods and only one hook per
rod is allowed. A dead or live bait tackle or lure using treble hooks in
fishing for predators, shall be regarded as one hook. A suitable landing net
(assembled) is to be available at all times.
14 Only micro-barbed or preferably barbless hooks are allowed.
15 Members may not use or be in possession of any firearm or other
offensive weapon, except a catapult or throwing stick used for delivering
groundbait.
16 No member may deliberately catch, trap or otherwise hunt, detain or
kill any animal or bird.
17 No member may interfere with any domestic animals on lands adjacent to
the canal.
18 IT IS A VERY SERIOUS OFFENCE AGAINST
THESE RULES TO LEAVE LITTER AND DISCARDED FISHING TACKLE IN THE WATER OR ON THE
BANKS.
19 ALL PERSONS FISHING SHALL REMOVE ALL
TRACES OF LITTER FROM THE AREA THEY HAVE BEEN FISHING WHETHER THEY HAVE LEFT IT
OR NOT, CONTRAVENTION OF THIS RULE WILL RESULT IN AN AUTOMATIC SUSPENSION.
20 The methods and the tackle for fly casting are prohibited from the
towpath.
21 Persons fishing may not leave unattended any fishing tackle with bait
in or out of the water. It is an offence to be more than two metres away from a
baited rod and line.
22 Fish may be retained only in a regulation keep net or a properly
designed carp sack and it must be released at the cessation of fishing. During daylight hours
ALL CARP MUST BE RETURNED IMMEDIATELY AFTER CAPTURE except on matches
where carp under 5lb may be kept in a keepnet for the duration of the match
only. When night fishing a carp may be retained in a properly designed carp
sack during the hours of darkness, for photographic and weighing purposes only
and must be returned one hour after dawn.
22(a) Any member fishing for that particular species to which a code of
conduct applies as determined by the Executive Committee and as detailed in the
permit, should follow all codes of conduct.
23 Day fishing is from 4am to 10pm from June 16 to October 31 and from
5am to 7pm from November 1 to March 14.
23(a) Fishing at night is permitted to persons holding a special night
permit. Night anglers must vacate swims by 6am on waters booked for matches on
that day. Juniors allowed to night fish only if accompanied by an adult having
a night permit.
24 NO NIGHT FISHING IS ALLOWED WITHIN 50
YARDS OF ANY PRIVATE DWELLING.
25 Disabled anglers take priority at the specially constructed fishing
stations along the canal.
26 A person or club having booked a section for an angling match shall
have first choice of swims, provided proper notice of the match has been posted
at the access points for at least 24 hours.
27 Any club failing to abide to rule 26 shall peg round any anglers
already fishing the section.
28 Any freelance angler shall not attempt to fish such a section until he
has contacted the match organiser and obtained his permission to commence
fishing.
29 No fishing match may be organised in any part of the canal without the
permission of the Association.
30a Each member club of the Association shall be allocated a section of
the canal to help maintain during the year.
30b The Fisheries Officer would try as far as possible, to allocate a
member club, a section of the canal as close as possible to that club's base.
30c Each club shall communicate with the Fisheries Officer as to when
they complete the work on their allocated section.
30d It is the member club's responsibility to ensure that their allocated
section is fishable prior to the start of the season and is kept to a fishable
standard, as necessary, throughout the season.
30e All close season work to be completed by 1st June so as to
give the Fishery Team a chance to inspect the venue. If they find a section has
not been done, the club will be contacted and asked to complete their work
during the last weekend of the close season.
30f Swims are to be cut at 20 metre intervals, allowing for overhead
power lines and other obstructions that would interfere with fishing. If the
section has permanent pegs, use them as a guide.
30g The bankside vegetation is to be cleared so as to make the swim 2
metres wide. Any sedges in front of the swim to be cut down 1 metre wide in the
middle of the swim to give fishable access to the water.
30h Permanent pegs may be repainted and/or replaced at the discretion of
the member club. As part of the member club's report to the Fisheries Officer,
any missing pegs should be noted.
30i Any work that the member club feels is beyond its capabilities should
be reported as soon as possible to the Fisheries Officer to enable the work to
be carried out by the Fishery Team.
30j If a member club has done their work during the close season and kept
the section up to standard throughout the season, £25 shall be paid to that
member club by the Association to help with their expenses.
30k Any member club that does no work on their allocated section during
the close season will not be allowed any matches on the canal for the next
season until such work has been done.
31 An award will be made for the best specimen of each species over the
minimum weights below:

Applicants must hold a current annual permit and must submit the claim,
in writing, to the Secretary or Match Secretary within 21 days of capture.
Names and addresses of two adult witnesses or one Association Officer or one
Bailiff must be supplied with the claim.
32 The use of bloodworm and joker is forbidden except under the following
conditions:

33 No tins of any description are to be taken onto the fisheries.
34 Fishing will only be permitted from permanent pegs ONLY where they are
provided.
35 Clubs booking matches must take up their options, no standby bookings
will be accepted, all pegs fees are to be paid.
36 Clubs organising matches with outside guests must pay the appropriate
peg fees.
37 Any member in breach of the rules, or failing to comply with the
legitimate request of a bailiff, is liable to have their permit confiscated,
subject to appeal.
38 THESE RULES SHALL NOT APPLY TO ANY
AUTHORISED PERSON IN PURSUIT OF THE FISHERY MANAGEMENT DUTIES OF THE
ASSOCIATION, NOR TO ANY CANAL AUTHORITY OFFCIER OR EMPLOYEE IN PURSUIT OF
PROFESSIONAL DUTIES.
1 The Association will run matches on an 'open' basis every second Sunday
of the month during the season.
2 The July match will be deemed the 'Basingstoke
Canal Team Championship' and will be open to teams of four. The 'Basingstoke Canal Team Shield' will be awarded
to the team attaining the most section points and will be kept by them for one year.
In the event of a tie on points then weight will be the decider.
3 The August match will be deemed the 'Basingstoke
Canal Individual Championships'. The 'Basingstoke Canal Individual Shield' will be
awarded to the winner and will be kept by him for one year.
4 The 'Lewis Harris Memorial Charity
Match' will be held midweek in early October. The 'Lewis Harris Memorial Charity Shield' will be
awarded to the winner and will be kept by him for one year. This match will be
run on an 'invitation only' basis.
Competitors will be required to raise a preset amount of sponsorship. All
proceeds of the match will be donated to a local charity.
5 The 'Alfred Burtoo Memorial Series'
will be fished on successive Wednesday evenings at the start of the season. The
series will be decided on aggregate section points, the lowest result to be
dropped. In the event of a tie on points then weight will be the decider. The 'Alfred Burtoo Memorial Shield' will be awarded
to the winner and will be kept by him for one year.
6 The Association may from time to time organise other large matches on
the canal. Every effort will be made by the Match Secretary to notify members
of such additional matches.
7 All Association matches will be run in line with NFA match rules,
unless otherwise directed by the EC.
8 In the case of a dispute the Match Secretary's decision is final.
However, the competitor may appeal to the EC on any dispute.
9 There shall be no categories of competitor.
10 Entrance fees will include the main pools monies and will be paid by
all competitors. However, on match day, there may be an additional 'super pool'
which will be optional.
